0. Who We Are

These Terms and Conditions (“Terms”) govern your access to and use of websites, storefronts, and services operated by 3 Gen Handbags and More, LLC and its subsidiaries 3 Gen Lagniappe and You Personalize This (collectively, “3 Gen,” “we,” “us,” or “our”). Our store(s) run on Shopify’s ecommerce platform.

Overview

1. Acceptance of Terms

Your use of any 3 Gen website, social channel, checkout, or service constitutes acceptance of these Terms. If you do not agree, do not use our site or services. 

We may update these Terms at any time by posting a revised version. Your continued use after any change is posted constitutes acceptance of the updated Terms. See Section 17 for change control. 

2. Eligibility and Account

·       You must be the age of majority in your jurisdiction to purchase. If you allow a minor dependent to use the site, you are responsible for that use. 

·       You agree to provide current, complete, and accurate information at checkout and to promptly update it, including email and payment details. 

·       We reserve the right to refuse or cancel orders, limit quantities per customer or household, and restrict sales in any jurisdiction. 

3. Online Store; Platform

Our store is hosted by Shopify Inc. Shopify provides the online ecommerce platform that enables us to sell products and services to you. Your use of Shopify-powered checkout is also subject to Shopify’s terms and privacy practices. 

4. Product Information and Availability

·       We work to display product colors, textures, and details accurately. Actual display depends on your device and we cannot guarantee precision.

·       Products or services may be available in limited quantities. We may discontinue or change items without notice. All offers are void where prohibited.

5. Pricing; Modifications

Prices are subject to change without notice. We may modify or discontinue any part of the service at any time. We are not liable for any modification, price change, suspension, or discontinuance. 

6. Orders; Billing Accuracy

·       We may refuse or cancel an order for any reason, including suspected fraud, reseller activity, or policy violations. If we change or cancel an order, we will attempt to notify you using the email, phone, or billing address provided at checkout.

7. Prohibited Conduct

You agree not to use the site for unlawful purposes or to violate any applicable laws. Prohibited conduct includes harassment, intellectual-property infringement, submitting false or misleading information, transmitting malware, collecting personal data of others without authorization, spamming, scraping, or interfering with security features. 

We will suspend or terminate access for violations. 

8. User Content; Feedback

If you submit reviews, comments, ideas, designs, or other materials (“Submissions”), you grant 3 Gen a worldwide, royalty-free, perpetual license to use, reproduce, publish, adapt, and display those Submissions in any media, without compensation. We may remove content in our sole discretion. 

You represent that your Submissions do not infringe third-party rights or contain unlawful content or malware. 

9. Personal Information

Your submission of personal information is governed by our Privacy Policy  

10. Errors and Omissions

From time to time there may be typographical errors or omissions relating to product descriptions, pricing, promotions, shipping charges, transit times, or availability. We may correct any errors and update or cancel orders if needed.

11. Third-Party Links and Tools

Our site may include links to third-party websites or tools we do not control. We provide access “as is” and “as available” without warranties or endorsements. Your use of third-party resources is at your own risk and subject to their terms.

12. Intellectual Property

All content on our site, including logos, graphics, text, photographs, product names, and software, is owned by or licensed to 3 Gen and is protected by intellectual property laws. You may not copy, reproduce, sell, resell, or exploit any portion without our prior written permission.

13. Warranty Disclaimer and Store Credit Policy

·       No Manufacturer Warranty
3 Gen Handbags and More, along with its subsidiaries 3 Gen Lagniappe and You Personalize This, does not manufacture the products offered on this site and therefore does not provide a manufacturer warranty. All items are sold as is, without any express or implied warranties, including but not limited to warranties of merchantability, fitness for a particular purpose, or non-infringement.

·       Condition and Quality Control
We rely on our third-party suppliers and fulfillment partners to provide accurate product descriptions and deliver quality merchandise. While we make every reasonable effort to ensure product accuracy, minor variations in color, texture, size, or design may occur and are not considered defects.

·       Store Credit for Verified Damage
If your order arrives with visible damage or defects, please contact us within 7 days of delivery. You must include clear photographs of:

    1. The damaged item(s)
    2. The shipping box and packaging
    3. The shipping label showing the tracking number

Once your claim is verified, we may issue a store credit in the form of an electronic gift card. Store credit may only be used toward future purchases at 3 Gen Handbags and More. Store credit is offered as a courtesy, not as a warranty or guarantee, and does not represent an admission of fault or liability by 3 Gen Handbags and More or its affiliates.

·       Exclusions

o   We do not offer store credit or replacements for:

      • Normal wear and tear
      • Misuse, accidental damage, or alterations
      • Delays, loss, or theft occurring after confirmed carrier delivery
      • Slight material or color variations due to display differences
      • Orders reported beyond the 7-day window

·       Customer Responsibility
Risk of loss transfers to the customer once an order is accepted by the carrier. We strongly encourage customers to monitor tracking updates and to request signature confirmation where possible.

14. Shipping, Risk of Loss, and Damage in Transit

Title and risk of loss pass to you when the carrier accepts the shipment. We are not responsible for delays, loss, theft, or damage caused by carriers once orders have been handed off.

If your order arrives damaged:

  1. Photograph the packaging and product within 48 hours,
  2. Save all materials,
  3. Contact us promptly at 3genhandbagsnmore at gmail.com with your order number.

We may assist with a carrier claim as a courtesy. Any store credit or replacement we issue for carrier-caused damage is discretionary and does not admit liability. We reserve the right to require a carrier claim, police report for theft, or signature confirmation on future orders.

15. Order Changes and Cancellations

Orders cannot be modified after processing. You may request cancellation within 24 hours of placing the order by emailing 3genhandbagsnmore at gmail.com with your order number. Approval depends on fulfillment status. If the order has shipped, standard returns rules apply.

16. Disclaimers; Limitation of Liability

The site, products, and services are provided “as is” and “as available” without warranties of any kind, express or implied, including merchantability, fitness for a particular purpose, title, or non-infringement.

To the maximum extent permitted by law, 3 Gen and its officers, employees, agents, affiliates, licensors, and suppliers are not liable for indirect, incidental, punitive, special, or consequential damages, or for lost profits, revenue, data, or goodwill, arising from your use of the site, products, or services. In all cases, our total liability will not exceed the amount paid by you for the product or service giving rise to the claim.

Some jurisdictions do not allow certain limitations; in those jurisdictions, our liability is limited to the maximum extent permitted by law.

17. Changes to the Service and to These Terms

You can review the current version of the Terms on this page. We may update Terms or policies at any time by posting to the site. Your continued use after posting constitutes acceptance. 

18. Termination

We may suspend or terminate access at any time for any reason. Obligations and liabilities incurred prior to termination survive termination.

19. Governing Law; Venue

These Terms are governed by the laws of the State of Illinois, without regard to conflict of law rules. The courts located in Cook County, Illinois have exclusive jurisdiction for any dispute that is not subject to arbitration, if applicable under Section 20.

20. Dispute Resolution; Arbitration Agreement

To promote efficient resolution, you agree to first contact us to attempt informal resolution. If we cannot resolve a dispute, any claim arising out of or relating to these Terms, the site, or purchases shall be resolved by binding individual arbitration administered by the American Arbitration Association under its Commercial Arbitration Rules. The seat of arbitration is Chicago, Illinois. Each party bears its own fees unless the arbitrator awards otherwise as permitted by law. Class actions and class arbitrations are not permitted. The arbitrator may award individualized relief only. If any part of this clause is found unenforceable, the remainder remains in effect.

This clause does not prevent either party from seeking temporary injunctive relief in court to protect intellectual property or confidential information.

21. Entire Agreement; Severability; No Waiver

These Terms and the policies referenced here constitute the entire agreement between you and 3 Gen and supersede prior agreements. If any provision is unlawful or unenforceable, it will be enforced to the maximum lawful extent and the remainder will continue in effect. Failure to enforce a provision is not a waiver.

MOBILE MESSAGING TERMS (SMS/MMS)

By opting in to receive text messages from 3 Gen, you agree to these Mobile Messaging Terms.

Program Description. You may receive automated marketing and transactional texts, including cart reminders, order updates, and support notices, to the mobile number you provide. Message frequency varies. Message and data rates may apply. Carriers are not liable for delayed or undelivered messages.

Opt In. You represent that you are the subscriber or authorized user of the number provided.

Opt Out. Text STOP to unsubscribe. You may receive a one-time confirmation text. For help, reply HELP or email 3genhandbagsnmore at gmail.com. Requests using other words or formats may not be recognized.

Supported Content. SMS TMs may be sent if MMS is not supported by your device or carrier.

Age. You must be at least 16. If you are between 16 and the age of majority, you must have parental or guardian consent.

Privacy. See our Privacy Policy (link once published) for how we handle personal data related to messaging.

Disputes. Disputes related to messaging are subject to the arbitration agreement in Section 20.

WARRANTY SUMMARY

  • Coverage: No manufacturer warranty is provided. All items are sold as is. However, 3 Gen Handbags and More may issue a store credit at its discretion for verified shipping damage or product defects reported within 48 hours of delivery.
  • Exclusions: Store credit is not available for normal wear and tear, misuse, accidents, alterations, improper care, minor variations in color or texture, or delays and damage occurring after carrier delivery.
  • Proof Required: Customers must submit clear photos of the item, packaging, and shipping label within 48 hours of receipt to qualify for review.
  • Responsibility After Delivery: Once an order is accepted by the carrier, risk of loss transfers to the customer. Issues reported beyond 48 hours are the customer’s responsibility.

ORDER MODIFICATIONS AND CANCELLATIONS

  • Modifications: Not available after processing.
  • Cancellations: Request within 24 hours by email with order number. Approval depends on status.

SHIPPING LIABILITY CLARIFICATION

  • Risk Transfer: Risk passes to customer when the carrier accepts the parcel.
  • Carrier Issues: Delays, loss, theft, or damage caused by carriers are not our liability.
  • Our Courtesy: We may assist with claims and may, at our sole discretion, issue a store credit or replacement after investigation. Any such accommodation is not an admission of liability.

MODIFICATIONS TO POLICIES

We may update these policies at any time by posting to this page with a new Effective Date. Continued use after changes constitutes acceptance.
